Acceptable Use Policy

The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.

Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Illegality

In any form, including but not limited to the unauthorised distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material.

Undesirable Content

Karachi Soft reserves the right to refuse service and/or access to its servers to anyone.

Karachi Soft do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Warez : Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Bulk / Spam Email

The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.

Adult Materials

Adult materials is not allowed at Karachi Soft.

Misuse Of Resources

Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum. Torrent and etc. softwares are prohibited on our servers.

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.

UNLIMITED USE POLICY

High bandwidth usage : Karachi Soft offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, Karachi Soft may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, Karachi Soft reserves the right to impose the High Resource Use Policy for the consideration of all customers.

HIGH RESOURCE USE POLICY

Resources are defined as bandwidth and/or processor utilization.

Karachi Soft may implement the following policy to its sole discretion :

When a website is found to be monopolising the resources available Karachi Soft reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Karachi Soft continues hosting the website for an additional fee.

Payment Policies

All accounts are set up on a prepay basis. Although Karachi Soft reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established.

In addition, Karachi Soft reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

In order to streamline our accounting procedures and keep costs down Karachi Soft runs a limited number of payment options.

Cash / Demand Drafts :

Karachi Soft accepts payment in cash or cheque with in Karachi and Demand Draft if outside Karachi..

30 Day Money Back Guarantee

Each of our web hosting plan carries a 30 day Money Back Guarantee. If you are not completely satisfied with our services within the first 30 days of your contract, you will be given a full refund of the contract amount excluding domain name registration fee. If a customer violates Karachi Soft's Terms of Use a refund will not be issued in the event of a cancellation.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Karachi Soft harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Karachi Soft, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Karachi Soft against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Karachi Soft' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Karachi Soft servers.

Karachi Soft will not be responsible for any damages your business may suffer. Karachi Soft makes no warranties of any kind, expressed or implied for services we provide. Karachi Soft disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non deliveries, wrong delivery. Karachi Soft reserves the right to revise its policies at any time.
